USCIS Issues New Guidance Expanding Pool of Foreign Nationals that can be issued a For I-862, Notice to Appear, instructing them to appear before an immigration judge on a certain date. This new policy will increase the pool of individuals that could be subject to removal proceedings. As always, the severity with which this will affect the foreign nationals depends on how it is actually implemented by USCIS.
